This paper discusses “impartiality thought experiments”, i.e., thought experiments that attempt to generate intuitions which are unaffected by personal characteristics such as age, gender or race. We focus on the most prominent impartiality thought experiment, the Veil of Ignorance (VOI), and show that both in its original Rawlsian version and in a more generic version, empirical investigations can be normatively relevant in two ways: First, on the assumption that the VOI is effective and robust, if subjects dominantly favor a certain (...) normative judgment behind the VOI this provides evidence in favor of that judgment; if, on the other hand, they do not dominantly favor a judgment this reduces our justification for it. Second, empirical investigations can also contribute to assessing the effectiveness and robustness of the VOI in the first place, thereby supporting or undermining its applications across the board. The Structure of Scientific Revolutions represented a milestone in the attempt to understand scientific development based on empirical observations. However, in the next decades after the publication of his book, history, psychology, and sociology became increasingly marginal in Kuhn’s discussions. In his last articles, Kuhn even suggested that philosophers should pay less attention to empirical data and focus more on “first principles.” The purpose of this article is, first, to describe this radical transformation in Kuhn’s methodological approach, from his initial (...) naturalism to his later and more strict philosophical stance. Next, I present some of the alleged justifications for explaining this transition, such as his interest in problems more firmly attached to the philosophical tradition and a desire for greater acceptance within this community. Although these factors certainly played a role in explaining Kuhn’s change, I also believe that an important theoretical component exerts a fundamental function in this transition: the idea that scientific development is a kind of evolutionary process, which is better understood through the use of abstract theoretical models, instead of sparse observations of scientific activity. This paper investigates whether 'even if A, B' is pragmatically polysemic, so that a nonconcessive conditional may have 'even if', and whether concessive conditionals, pragmatically defined, can fail to have 'even if' or a non-temporal 'still'. Different paraphrases are used to help elucidate pragmatic meanings. A theory of the pragmatic meanings of concessive and implicative conditionals is presented. The semantic meaning of 'even if' and the question of whether concessive conditionals imply the truth of their consequents are also discussed.

An extended examination of Libet's works led to a comprehensive reinterpretation of his results. According to this reinterpretation, the Minimum Train Duration of electrical brain stimulation should be considered as the time needed to create a brain stimulus efficient for producing conscious sensation and not as a basis for inferring the latency for conscious sensation of peripheral origin. Latency for conscious sensation with brain stimulation may occurafterthe Minimum Train Duration. Backward masking with cortical stimuli suggests a 125-300 ms minimum value (...) for the latency for conscious sensation of threshold skin stimuli. Backward enhancement is not suitable for inferring this latency. For determining temporal relations between stimuli that correspond to subjects' reports, theendof cerebral Minimum Train Duration should be used as reference, rather than its onset. Results of coupling peripheral and cortical stimuli are explained by a latency after the cortical Minimum Train Duration, having roughly the same duration as the latency for supraliminal skin stimuli. Results of coupling peripheral stimuli and stimuli to medial lemniscus (LM) are explained by a shorter LM latency and/or a longer peripheral latency. This interpretation suggests a 230 ms minimum value for the latency for conscious sensation of somatosensory near-threshold stimuli. The backward referral hypothesis, as formulated by Libet, should not be retained. Long readiness potentials preceding spontaneous conscious or nonconscious movements suggest that both kinds of movement are nonconsciously initiated. The validity of Libet's measures of W and M moments (Libet et al., 1983a) is questionable due to problems involving latencies, training, and introspective distinction of W and M. Veto of intended actions may be initially nonconscious but dependent on conscious awareness. (shrink)

It is argued that contraposition is valid for a class of natural language conditionals, if some modifications are allowed to preserve the meaning of the original conditional. In many cases, implicit temporal indices must be considered, making a change in verb tense necessary. A suitable contrapositive for implicative counterfactual conditionals can also usually be found. In some cases, the addition of certain words is necessary to preserve meaning that is present in the original sentence and would be lost or changed (...) in the contrapositive without them. A distinction is made between adding new meaning and adding new words to preserve existing meaning. For concessive conditionals and relevance conditionals, however, no valid contrapositive can be found. They do not belong to the class of contraposable conditionals, which can be independently defined. Difficult cases are also discussed in which the contradictory of the consequent semantically entails the truth of the antecedent. In such cases the content of the antecedent is implicit in the meaning of the consequent. Contraposition becomes possible if what is implicit in the original consequent is made explicit in the contrapositive antecedent. (shrink)

1. Introduction The readiness potential was found to precede voluntary acts by about half a second or more (Kornhuber & Deecke, 1965). Kornhuber (1984) discussed the readiness potential in terms of volition, arguing that it is not the manifestation of an attentional processes. Libet discussed it in relation to consciousness and to free will (Libet et al. 1983a; 1983b; Libet, 1985, 1992, 1993). Libet asked the following questions. Are voluntary acts initiated by a conscious decision to act? Are the physiological (...) facts compatible with the belief that free will determines our voluntary acts? What is the role of consciousness in voluntary action? In this paper I will discuss these questions and the answers that Libet gave to them. (shrink)

Claims that necessary and sufficient conditions are not converse relations are discussed, as well as the related claim that If A, then B is not equivalent to A only if B . The analysis of alleged counterexamples has shown, among other things, how necessary and sufficient conditions should be understood, especially in the case of causal conditions, and the importance of distinguishing sufficient-cause conditionals from necessary-cause conditionals. It is concluded that necessary and sufficient conditions, adequately interpreted, are converse relations in (...) all cases. (shrink)

Libet's (2000) arguments in defense of his interpretation of his experimental results are insufficient. The claims of my critical review (Gomes, 2008) do not suffer with his new statements.

A commentary on articles by Klein, Pockett, and Trevena and Miller, in this issue, is given. Average shift in the point of subjective equality , calculated by Klein on Libet's data, and corresponding change in mean shift, calculated by Libet et al. , may be “corrected,” taking as a reference point the end of the minimum train duration. Values obtained, if significant, indicate a latency for conscious sensation of the skin stimulus of at least 230 ms. Pockett's main conclusions are (...) favored, but her explanation of peripheral–lemniscal couplings is found to be unconvincing. Trevena and Miller's article unsuccessfully tries to rescue a dualist interactionist view. Libet's method of timing intentions is thoroughly criticized. (shrink)

The free will problem is defined and three solutions are discussed: no-freedom theory, libertarianism, and compatibilism. Strict determinism is often assumed in arguing for libertarianism or no-freedom theory. It assumes that the history of the universe is fixed, but modern physics admits a certain degree of randomness in the determination of events. However, this is not enough for a compatibilist position—which is favored here—since freedom is not randomness. It is the I that chooses what to do. It is argued that (...) the core of the free will problem is what this I is. A materialist view is favored: The I is an activity of the brain. In addition to absence of external and internal compulsion, freedom involves absence of causal sufficiency of influences acting on the I. A more elaborate compatibilist view is proposed, according to which causal determination is complete when we add events occurring in the I (of which the subject is not conscious). Contrary to what several authors have argued, the onset of the readiness potential before the decision to act is no problem here. The experience of agency is incomplete and fallible, rather than illusory. Some consequences of different views about freedom for the ascription of responsibility are discussed. (shrink)

An examination of conditionals in di¤erent languages leads to a distinction of three types of conditionals instead of the usual two (indicative and subjunctive). The three types can be explained by the degree of acceptance or as-if acceptance of the truth of the antecedent. The labels subjunctive and indicative are shown to be inadequate. So-called indicative conditionals comprise two classes, the very frequent uncertain-fact conditionals and the quite rare accepted-fact conditionals. Uncertain-fact conditionals may have a time shift in contemporary English (...) and the future subjunctive in Portuguese (though not all of them do). Moreover, paraphrases of if with in case or supposing are usually possible with approximately the same meaning. Accepted-fact conditionals never have these features. (shrink)

Hodgson’s (Journal of Consciousness Studies, 12 (1), 2005) defense of the plain person’s view that free will exists in conscious voluntary action is discussed. His position against the view that human action is automatically determined is favored, but his view that free will is incompatible with natural causation is countered. Eccles’ hypothesis to account for the presence of a readiness potential prior to a conscious decision to act now is discussed. It is argued that it is possible to preserve what (...) is good in a plain person’s concept of free will in a way that is compatible with natural causation. (shrink)

In a provocative article published in the Journal of Consciousness Studies, Susan Pockett argues for the plausibility of considering consciousness as an epiphenomenon of neural activity. This means that consciousness, though caused by the brain, would not in its turn have any role in the causation of neural activity and, consequently, of behaviour. Critical for her argument is the distinction she makes between 'consciousness per se' and 'the neural processing that accompanies it' . In her discussion, though, the author begs (...) the question concerning whether there really is such 'consciousness itself, as distinct from the neural processing that goes with it' . If consciousness as it exists happens not to be distinct from some sort of neural processing, then Pockett's 'consciousness per se' has no causal effect simply because it does not exist. (shrink)

The prima facie heterogeneity between psychical and physical phenomena seems to be a serious objection to psychoneural identity thesis, according to many authors, from Leibniz to Popper. It is argued that this objection can be superseded by a different conception of consciousness. Consciousness, while being conscious of something, is always unconscious of itself . Consciousness of being conscious is not immediate, it involves another, second-order, conscious state. The appearance of mental states to second-order consciousness does not reveal their true nature. (...) Psychoneural identity can thus be considered a valid hypothesis. Related views of Kant, Freud, Shaffer, Bunge and others are considered. “Naive psychical realism” is criticised. Consciousness of mental events is considered as the result of the action of a cerebral system that observes the neural events hypothetically identical to mental events. Reinterpretations of Libet's results have received support from most commentaries. Libet's arguments against alternative hypotheses are contested. Latency depends on intensity. Integration of intensity and duration explains the Minimum Train Duration. Analogies of Libet's timing of intentions with control experiments indicate biases of opposite signs, according to intramodal or intermodal results. Rosenthal's view of nonconscious intentions becoming conscious after a delay is favored. Compatibilist free will is discussed.

The rationality of the human being applied in science-technique in the contemporary capitalist system is distorted; the purpose, which is the good life for human beings, has become the means to sustain and feedback the technicist system of technological capitalism. Thus, the modus operandi of science, aims only to legitimize technology, apart from the ethics applied in this relationship between technology and human beings, and cut off from critical philosophical thinking. With the result presented, the problem lies in the reason (...) of the contemporary human being, who seeks to satisfy his desires and envisions the good life (eudaimonía) in material goods, suppressing the contemplative leisure of life (ataraxia); becoming a slave to the system it fosters. The objective is to demonstrate the need to reformulate the modern system, in order to earn a good life for human beings as a purpose of technical science, which should be the means for this and as technological advances in favor of the quality of human beings. and, not for capitalist reproduction. The research methodology is an exploratory bibliography, exposing and dialoguing with authors on the subject in order to forge our conclusion, that pleads for science-technical that enjoys ethics and human reason in favor of eudaimonia. A commentary is given on Trevena and Miller . The comparability of their experimental task and of the potential they recorded with those used and recorded by Libet, Gleason, Wright, and Pearl is questioned. An interpretation is given for the similarity of event-related potentials recorded when subjects decided to move and when they decided not to move.

Varzi (2005) discussed 6 ways of symbolizing the sentence 'If Alf went to the movies then Beth went too, but only if she found a taxi-cab.' In the present reply, a seventh symbolization is offered, along with an analysis of the six alternatives discussed by Varzi.

Conditional assertions are a peculiar language structure that manifests a specific cognitive operation. In order to express it, different languages have found different ways of using verb forms. Primary conditionals are here defined as those that presuppose the possibility of the falsity of both the antecedent and the consequent. In them, the truth of the antecedent appears as a sufficient condition for the truth of the consequent. The truth condition of primary conditionals is defined as the impossibility of the conjunction (...) of the truth of the antecedent with the falsity of the consequent. The demand for a connection between antecedent and consequent, expressed by Chrysippus as the incompatibility between the affirmation of the antecedent and the denial of the consequent, is thus satisfied. Counterfactuals are conditionals that speak of some aspect of reality through the imagination of an unreal situation. (shrink)

While agreeing with Fischborn’s (2018) contention that, according to one traditional definition of compatibilism, my position should be classified as that of a libertarian incompatibilist, I argue here for a different view of compatibilism. This view involves, on the one hand, local probabilistic causation of decisions (rather than universal strict determinism) and, on the other, free will conceived as involving decisions generated by a decision-making process carried out by the brain, which consciously contemplates different alternatives and could in principle have (...) been different from what it was, implying that the agent could in normal conditions have done otherwise in the same circumstances. After discussing different views of causation (including determinism) and of free will, I make a revision of some passages from my earlier work, quoted by Fischborn. I conclude that what is crucial in the question of (in)compatibilism is the (in)compatibility between freedom of decisions and natural causation of human actions. According to this looser and, I argue, more pertinent view of compatibilism, I maintain my previous classification of my position on the matter as compatibilist. (shrink)

Judgments about the validity of at least some elementary inferential patterns(say modus ponens) are a priori if anything is. Yet a number of empirical conditions mustin each case be satisfied in order for a particular inference to instantiate this or that inferentialpattern. We may on occasion be entitled to presuppose that such conditions aresatisfied (and the entitlement may even be a priori), yet only experience could tell us thatsuch was indeed the case. Current discussion about a perceived incompatibility betweencontent externalism (...) and first-person authority exemplifies how damaging the neglect ofsuch empirical presuppositions of correct reasoning can be. An externalistic view of mentalcontent is ostensibly incompatible with the assumption that a rational subject should beable to avoid inconsistency no matter what the state of her empirical knowledge may be.That fact, however, needs not be taken (as it often is) as a reductio of externalism: alternatively,we may reject that assumption, adding to the agenda of a philosophical investigationof rationality an examination of the vicissitudes of logical luck. 'Consciousness' is used in different ways, but not all of these uses reflect clear concepts. In his target article Christian de Quincey (2006) notes that confusion about consciousness is widespread and sets out to distinguish two main meanings of the word. However, his treatment of the subject is confused and the proposed distinction misses the point. I argue that the effort to clarify the meaning of consciousness should proceed in a different direction. We should first find some empirical criterion that (...) allows one to distinguish between being conscious and being unconscious of something in some typical cases. Then we may try to envisage other cases in which a person or animal may be conscious or unconscious of something. Finally, we should try to understand what the difference is between these states. Freedom is often defined by the possibility of doing otherwise. The conditional interpretation of this possibility, advanced by Moore, maintains that to say that someone could have done otherwise is to say that someone would have done otherwise if she had decided to do so. This conception is adequate for the thesis that freedom is compatible with natural causality. The present article presents a defense of this interpretation against the argument with which Lehrer purports to have refuted it. As used (...) in ordinary language, one of the conditionals of the argument has a different sense from that captured in Lehrer’s formalization. In a context that includes the premise that the subject would do otherwise if she decided to do so, the assertion that she could do otherwise only if she decided to do so acquires the meaning that she would do otherwise only if she decided to do so. Without this interpretation, the meaning of ‘can’ in the argument is different from its meaning in ordinary language, since the possibility of doing otherwise would imply really doing otherwise. Abstract in Portuguese: A liberdade é freqüentemente definida pela possibilidade de agir diferentemente. A interpretação condicional dessa possibilidade, proposta por Moore, sustenta que dizer que alguém poderia ter agido diferentemente é dizer que alguém teria agido diferentemente, se assim tivesse decidido. Esta concepção é adequada à tese da compatibilidade entre liberdade e causalidade natural. O presente artigo apresenta uma defesa dessa interpretação contra o argumento com que Lehrer pretendeu contestá-la. Tal como usado na linguagem corrente, um dos condicionais do argumento tem sentido diverso daquele capturado na formalização de Lehrer. No contexto que inclui a premissa de que o sujeito agiria diferentemente se assim decidisse, a afirmaçãode que ele só poderia agir diferentemente se assim decidisse tem o sentido de que ele só agiria diferentemente se assim decidisse. Sem essa reinterpretação, o sentido de ‘poder’, no argumento, distancia-se da linguagem corrente, pois, no caso, poder agir diferentemente implicaria em assim efetivamente agir. (shrink)

Se resaltan algunas peculiaridades sobre la manera como la Asociación Médica Mundial enfoca ciertos temas, ya que sus declaraciones y resoluciones reflejan cambios más o menos apreciables, que son manifiestos en los contenidos de ellas y orientan sus políticas. Se hace un comentario comparativo de las versiones de la Declaración de Ginebra de 1948 y 2017 con el Juramento hipocrático teniendo en cuenta las siguientes categorías: Carácter de la declaración; Tiempo verbal; Extensión en apotegmas o sentencias; núcleo epistémico; omisiones; innovaciones; (...) tipo de ethos. Las facultades de Medicina deberían incluir en sus currículos los acentos y contenidos convenientes para que el ethos hipocrático se conserve y la profesión médica pueda seguir gozando de la confianza, el respeto y el honor, que solo se mancillan cuando en la práctica profesional se cede terreno por intereses autónomos y economicistas. This thesis explores the possibility of theoretically conceiving consciousness as an activity of the brain. Objections, based on the concept of qualia, to the identification of consciousness with a brain activity are refuted. Phenomenal consciousness is identified with access-consciousness. Consciousness is conceived as a higher order processing of informational states of the brain. The state of consciousness represents an integration of prior nonconscious states. Libet’s research on the timing of conscious experience is reviewed and analyzed. His hypothesis of backward referral (...) is rejected. Since specific brain activity (the readiness potential) precedes the conscious intention, the implications of this fact on the concepts of volition and free will are discussed. Non-deliberate voluntary acts are performed without a prior consciousness of the intention to perform them. Conversely, the decision to perform a deliberate act is influenced by consciousness of the intention. Free will is viewed as compatible with the causal determination of mental processes. The theory is successfully applied to the different contents of consciousness: consciousness of perceptions, of bodily sensations, of actions, of memories, of ideas, of thoughts, of language, of affective states, of beliefs, of desires, of oneself and consciousness of being conscious. The relation between the theory of consciousness and psychoanalysis is also explored. Psychoanalysis is seen as compatible with the proposed theory, which is able to enlighten some aspects of the process of becoming conscious in psychoanalytic treatment. The general approach is interdisciplinary : the theory must take into account constraints derived from philosophy, neurophysiology, psychology, neuropsychology, etc. Consciousness is conceived, not as a property of some mental states, but as a specific higher-order activity, based on lower-order nonconscious activities. The Ontology for Biomedical Investigations (OBI) is an ontology that provides terms with precisely defined meanings to describe all aspects of how investigations in the biological and medical domains are conducted. OBI re-uses ontologies that provide a representation of biomedical knowledge from the Open Biological and Biomedical Ontologies (OBO) project and adds the ability to describe how this knowledge was derived. We here describe the state of OBI and several applications that are using it, such as adding semantic expressivity to (...) existing databases, building data entry forms, and enabling interoperability between knowledge resources. OBI covers all phases of the investigation process, such as planning, execution and reporting. It represents information and material entities that participate in these processes, as well as roles and functions. Prior to OBI, it was not possible to use a single internally consistent resource that could be applied to multiple types of experiments for these applications. OBI has made this possible by creating terms for entities involved in biological and medical investigations and by importing parts of other biomedical ontologies such as GO, Chemical Entities of Biological Interest (ChEBI) and Phenotype Attribute and Trait Ontology (PATO) without altering their meaning. OBI is being used in a wide range of projects covering genomics, multi-omics, immunology, and catalogs of services. OBI has also spawned other ontologies (Information Artifact Ontology) and methods for importing parts of ontologies (Minimum information to reference an external ontology term (MIREOT)). The OBI project is an open cross-disciplinary collaborative effort, encompassing multiple research communities from around the globe. To date, OBI has created 2366 classes and 40 relations along with textual and formal definitions. The OBI Consortium maintains a web resource providing details on the people, policies, and issues being addressed in association with OBI. (shrink)

According to a widespread view, Thomas Kuhn’s model of scientific development would relegate rationality to a second plane, openly flirting with irrationalist positions. The intent of this article is to clarify this aspect of his thinking and refute this common interpretation. I begin by analysing the nature of values in Kuhn’s model and how they are connected to rationality. For Kuhn, a theory is chosen rationally when: i) the evaluation is based on values characteristic of science; ii) a theory is (...) considered better the more it manifests these values; and iii) the scientist chooses the best-evaluated theory. The second part of this article deals with the thesis of the variability of values. According to Kuhn, the examples through which epistemic values are presented vary for each person, and for this reason individuals interpret these criteria differently. Consequently, two scientists, using the same values, can come to a rational disagreement over which theory to choose. Finally, I point out the limitations of this notion of rationality for the explanation of consensus formation, and the corresponding demand for a sociological theory that reconnects individual rationality with convergence of opinions. En el ámbito de la teoría general de la relatividad (TGR), se considera que el espaciotiempo es una entidad real. En este sentido, atendiendo al realis mo sobre entidades, surgen problemas como ¿qué tipo de entidad es el espaciotiempo?, ¿cuál es su naturaleza? Tradicionalmente, en atención a dicha teoría conviven dos concepciones realistas: la substancialista, donde el espaciotiempo sería una substancia; y la relacionista, tal que el espaciotiempo correspondería a una “relación entre substancias”.

Experimental ethicists investigate traditional ethical questions with non-traditional means, namely with the methods of the empirical sciences. Studies in this area have made heavy use of philosophical thought experiments such as the well-known trolley cases. Yet, the specific function of these thought experiments within experimental ethics has received little consideration. In this paper we attempt to fill this gap. We begin by describing the function of ethical thought experiments, and show that these thought experiments should not only be classified according (...) to their function but also according to their scope. On this basis we highlight several ways in which the use of thought experiments in experimental ethics can be philosophically relevant. We conclude by arguing that experimental philosophy currently only focuses on a small subcategory of ethical thought experiments and suggest a broadening of its research agenda. (shrink)

Russell’s theory of memory as acquaintance with the past seems to square uneasily with his definition of acquaintance as the converse of the relation of presentation of an object to a subject. We show how the two views can be made to cohere under a suitable construal of ‘presentation’, which has the additional appeal of bringing Russell’s theory of memory closer to contemporary views on direct reference and object-dependent thinking than is usually acknowledged. The drawback is that memory as acquaintance (...) with the past falls short of fulfilling Russell’s requirement that knowledge by acquaintance be discriminating knowledge – a shortcoming shared by contemporary externalist accounts of knowledge from memory. Es decir, los mitos políticos están compuestos manifiestamente de dos componentes básicos. Por un lado, consisten en la así llamada política simbólica y por el otro lado, (...) son parte de la memoria colectiva. Es por esto que los mitos se enfrentan con las bases mismas del proyecto de modernidad, quizás la razón por la cual sea la politología la disciplina de las ciencias sociales que menos los ha estudiado. La utopía andina, el mahdi o el doceavo imán, el emperador alemán oculto y dormido y el bolivarianismo, constituyen algunos estos mitos políticos. (shrink)

This Article defines four distinct conceptions of cruelty found in underdeveloped form in domestic and international criminal law sources. The definition is analytical, focusing on the types of agency, victimization, causality, and values in each conception of cruelty. But no definition of cruelty will do justice to its object until complemented by the kind of understanding practical reason provides of the implications of the phenomenon of cruelty. -/- No one should be neutral in relation to cruelty. Eminently, cruelty in criminal (...) law, a human-created phenomenon, vigorously calls for responses in the form of preventive and corrective action on the part of private and public actors. It is in this sense that cruelty is a problem of practical reason, one of action preoccupied with its legal or moral obligations, rational grounds, value commitments, and actual consequences. -/- However, the connection between conceptions of cruelty and the implications practical reason can draw from the correct application of a conception of cruelty to phenomena in the world remains too detached to be able to capture and explain people's actual experiences both of seeing cruelty in the world and of confronting the question of what to do about cruelty and how to address its cultural and institutional aspects. Something is missing. -/- What is missing is the integration of conceptions of cruelty and the practical reason implications of detecting cruelty in the world into normative models which operate as meaning matrixes for cognition, meaning, and action. This Article undertakes this explanatory task through an exercise of reconstructing seminal philosophical ideas about cruelty. The result is that the four conceptions of cruelty are placed within three distinct normative models, which ultimately render intelligible legal conceptions of cruelty and legal reactions to it. El título del comentario hace alusión a la permanente actitud de principios de Sánchez Vázquez, quien mantuvo, primero, una actitud crítica ante (...) el marxismo ortodoxo y dogmático que se difundía desde la URSS y el llamado socialismo real y, después, asumió estoicamente la defensa del marxismo cuando aquellos habían desaparecido. In this paper I pursue an avenue of argument implicit in Patristic thinkers — such as Tertullian and Athanasius — and explicit in the thomistic and scholastic tradition. I argue that there is an ontological unity to the world, and that this unity calls for an explanation in terms of a transcendent cause, traditionally identified with God.

We discuss some basic issues underlying the natural numbers: induction and recursion. We examine recursive formulations and their use in establishing universal and particular properties.

What is cruelty? How and why does it matter? What do the legal rejection of cruelty and the requirements of mercy entail? This essay asks these questions of Lucius Seneca, who first articulated an agent-based conception of cruelty in the context of punishment. The hypothesis is submitted that the answers to these questions offered in Seneca's De clementia constitute one of the turning points in the evolution of practical reason in law. I conclude, however, by arguing that even the mainstream (...) punitive practices of contemporary western societies fail to meet the modest imperatives of the rejection of cruelty and the unconditionality of mercy propounded by Seneca. Cependant, l’assimilation existentielle de l’impossibilité de la métaphysique par Kleist déclenche non seulement le sentiment de finitude et d’humilité de la raison, mais aussi le refus tragique, désespéré, d’une science strictement phénoménale et d’une solution croyante pour apaiser son besoin de vérité absolue. Ainsi, une catastrophe, comme le tremblement de terre de Lisbonne ou du Chili, convoque des significations contrastées : Kant s’attache à la mécanique naturelle et à la possibilité d’un dessein inscrutable, tandis que Kleist éprouve la vie sous le signe du hasard, « voyage sans but », dont le mouvement offre le dynamisme diasporique du salut impossible. Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. Oscillating between heterophagia and heterophilia, this fundamental type of temporal eroticism embodies various phenomenological configurations whose ideal typology reveals a deep correlation between a metaphysical decision (oriented towards either constructivist idealism or affective realism) with an ethical attitude (ranging from individualistic scepticism to absolute heterodicy). The analysis of mutual contrasts defining Sartre’s, Merleau-Ponty’s and Levinas’ onto-ethic stances is adopted as a methodological device in order to elucidate a broad topology of incommensurabilia and desiderata. Le pari de cet ouvrage est d'explorer les facettes multiples à travers lesquelles se donne le soi. Parler de soi plutôt que de moi implique une rupture franche avec les philosophies qui placent le sujet humain en position fondatrice. Le soi est encore moins une « chose » mais un mode d'être ; le soi n'est pas une donnée mais une conquête dont le devenir est en partie indéterminé. C'est donc sous le signe des épreuves qu'il faut penser les variations (...) phénoménologiques et herméneutiques sur le soi. Si la philosophie reste la discipline dominante des réflexions qui parcourent les contributions du volume, l'originalité de cet ouvrage est d'offrir en même temps au lecteur d'autres variations par lesquelles se décline le soi. Cet ouvrage propose une réinterprétation originale du rôle cognitif du Je pense kantien qui se veut pertinente pour la phénoménologie et pour la philosophie actuelle de l’esprit. L’étude du rapport entre temporalité phénoménale et cognition catégoriale constitue le fil conducteur de cette recherche. Elle mène à la question capitale du statut ultime du Moi, du sens du Je du Je pense. Que désigne-t-il : un épiphénomène contingent, une représentation sui generis, une métareprésentation, un acte indéconstructible, un événement fonctionnel, une forme (...) logique ? Recèle-t-il une véritable unité ou plutôt une multiplicité productrice d’unité ? Représente-t-il une identité réelle ou un changement identifiable, un référent vide ou ‘saturé’ ? La réponse à toutes ces questions dépend notamment de la façon de concevoir l’efficacité du Je, c’est-à-dire de l’articulation entre inconscient cognitif, conscience de soi et conscience de quelque chose en général. En pensant Kant avec la philosophie moderne et contemporaine, l’auteur tente d’élucider l’instabilité inévitable du passage critique à un Cogito postmétaphysique. (shrink)

The development of the Functional Genomics Investigation Ontology (FuGO) is a collaborative, international effort that will provide a resource for annotating functional genomics investigations, including the study design, protocols and instrumentation used, the data generated and the types of analysis performed on the data. FuGO will contain both terms that are universal to all functional genomics investigations and those that are domain specific. In this way, the ontology will serve as the “semantic glue” to provide a common understanding of data (...) from across these disparate data sources. In addition, FuGO will reference out to existing mature ontologies to avoid the need to duplicate these resources, and will do so in such a way as to enable their ease of use in annotation. This project is in the early stages of development; the paper will describe efforts to initiate the project, the scope and organization of the project, the work accomplished to date, and the challenges encountered, as well as future plans. Some "major" evolutionary transitions have been described as transitions in individuality. In this depiction, natural selection might bring about new kinds of individuals, whose evolutionary dynamics takes place in a novel way. Using a categorization proposed by Godfrey-Smith, this transition is fully accomplished when a new "paradigmatic" Darwinian population emerges. In this paper I investigate whether at some point in the evolution in the hominin lineage a transition of this kind might have happened, by assuming some of the theses of (...) dual inheritance theory, especially about the role played by a conformist bias. I argue that Godfrey-Smith misses in his book a scenario in which conformism is one of the preconditions for a transition towards a Darwinian population of cultural groups. (shrink)

La noticia de la conclusión del primer pangenoma humano ocurre veinte años después de que se pudo contar con una versión de referencia de la información genética completa de la especie humana. Las limitaciones técnicas de ese tiempo permitieron que esa versión tuviera errores y varias lagunas de la información genética. Ahora es posible contar con un nuevo atlas gigante con información que permite evidenciar la gran diversidad genética de la especie humana. Este trabajo está siendo realizado por el Consorcio (...) Internacional de Referencia del Pangenoma Humano, del que hacen parte cerca de cien investigadores y está financiado por el Instituto Nacional de Investigación del Genoma Humano y por los Institutos Nacionales de Salud de EEUU. En este escrito que describe a grandes rasgos en qué consiste el proyecto, cuáles son sus aplicaciones posibles y las dificultades técnicas que tiene actualmente. Se repasan también algunos aspectos éticos y jurídicos y se dan pautas para su culminación: profundizar en la reflexión ética de los problemas que se generan; cuidar la formación en ética de la investigación, bioética e integridad científica en todos los actores del proceso; no perder de vista la Declaración Universal sobre el genoma humano y los derechos humanos de la UNESCO; orientar los desarrollos de la bioinformática, para que los datos obtenidos se manejen de una mejor manera; extremar la prudencia en el manejo de esos datos; revisar y reajustar las prioridades que se tienen en la investigación de estas temáticas. La maternidad subrogada es una respuesta técnica ante una dificultad biológica que se puede dar en la reproducción humana. Luego de una introducción, que muestra la problemática que la guerra en Ucrania ha ocasionado en esta materia, se exponen algunas generalidades sobre la maternidad subrogada, su presencia en el mundo y sus costos; así mismo, se reflexiona sobre los problemas éticos, bioéticos y biojurídicos desde las perspectivas biológica, antropológica y jurídica en cada uno de los actores del proceso (madre sustituta, (...) pareja o persona contratante, el embrión resultante y la sociedad). Se concluye que la maternidad subrogada, aunque sea técnicamente posible, no es una solución ética ni bioética para la esterilidad humana porque deja de lado el respeto a la dignidad; es un negocio que incluye explotación de mujeres; impone actuaciones jurídicas que fuerzan la realidad al declarar como derechos lo que no son más que deseos y es causa de varias formas de vulnerabilidad en las personas que intervienen en ella y en la sociedad en su conjunto. Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. La relación del ser humano con el medio ambiente también debe cambiar, apelando a la responsabilidad humana por el cuidado del planeta. (shrink)
